Die Geschäftsbedingungen regeln das Vertragsverhältnis zwischen dem Teilnehmenden des Black Forest Events 2018 und dem Veranstalter Plantco.de e.V., Geschäftsstelle Leopoldring 5, 79098 Freiburg.
Die Anmeldung zur Teilnahme erfolgt online über die Veranstaltungswebsite [http://plantco.de/BFW2018/]. Die Anmeldung stellt ein verbindliches Angebot zum Abschluss eines Vertrages dar. Der Vertrag kommt erst mit der Annahme durch Plantco.de e.V. zu Stande. Soweit die Anmeldung zur Veranstaltung berücksichtigt werden kann, erhalten die Teilnehmenden eine Anmeldebestätigung per E-Mail.
Die Teilnahmegebühr ist der Registrierungsseite zu entnehmen. Der dort genannte Betrag umfasst die Teilnahme an der Veranstaltung (Übernachtung im Leistungszentrum Herzogenhorn, inkl. Shuttle von und nach Bärental Bahnhof, Welcome Drink, Verpflegung incl. ein Getränk pro Mahlzeit, sowie Pausenverpflegung incl. Kaffee, Unterlagen, Exkursionen und Ausflüge). Nicht im Preis enthalten ist die Anreise nach Bärental, sowie Getränke außerhalb der Mahlzeiten. Unsere Preise verstehen sich inkl. Mehrwertsteuer (MwSt).
Ersatzteilnehmender
Sie können jederzeit anstelle des angemeldeten Teilnehmenden einen Vertreter benennen. Ihnen entstehen dadurch keine zusätzlichen Kosten, solange dadurch keine Probleme mit der Bettenverteilung (z.B. aufgrund anderen Geschlechts) entstehen.
Stornierung
Sie können jederzeit vom Vertrag zurücktreten. Dies ist jedoch nur schriftlich möglich. Bitte wenden Sie sich dazu direkt an die o.g. postalische Adresse oder per E-Mail an
bfss2018@plantcode-mail.biologie.uni-marburg.de.
Geht die Rücktrittserklärung bis zu 40 Tage vor Tagungsbeginn bei Plantco.de e.V. ein, wird die Buchung storniert, die Bearbeitungsgebühr beträgt EUR 25,00. Ab dem 41. Tag bzw. bei Nichterscheinen wird die gesamte Teilnahmegebühr fällig. Bei Stornierung nach dem 41. Tag bzw. Nichterscheinen erhält der Teilnehmende auf Wunsch die Tagungsunterlagen zugeschickt.
Plantco.de e.V. kann die Veranstaltung jederzeit aus organisatorischen oder sonstigen wichtigen unvorhersehbaren Gründen (u. a. höhere Gewalt, geringe Teilnehmerzahl oder bei Ausfall mehrerer ReferentInnen) absagen und den Vertrag außerordentlich kündigen. In diesem Fall entfallen die gegenseitigen Leistungsverpflichtungen der Parteien; der Teilnehmende erhält seine bereits geleistete Teilnahmegebühr zurück. Weitergehende Haftungs- und Schadensersatzansprüche, insbesondere Ersatzleistungen für bereits gebuchte Flug-, Bahn- oder andere Beförderungstickets sowie erfolgte Hotelbuchungen, sind, soweit nicht Vorsatz oder grobe Fahrlässigkeit vorliegt, ausgeschlossen.
Plantco.de e.V.ist berechtigt notwendige inhaltliche, methodische und organisatorische Änderungen oder Abweichungen vor oder während der Veranstaltung vorzunehmen, soweit diese den Nutzen der angekündigten Veranstaltung für den Teilnehmenden nicht wesentlich ändern. Wir sind berechtigt, die vorgesehenen ReferentInnen im Bedarfsfall (z. B. Krankheit, Unfall) durch andere hinsichtlich des angekündigten Themas ähnlich qualifizierte Personen zu ersetzen.
Plantco.de e.V. haftet unbeschränkt nur für Vorsatz und grobe Fahrlässigkeit ihrer gesetzlichen Vertreter und Erfüllungsgehilfen. Plantco.de e.V. haftet nicht für den Verlust von zu Veranstaltungen mitgebrachten Sachen.
Die Teilnehmenden erkennen das Urheberrecht von Plantco.de e.V. und/oder der ReferentInnen/Dritten an den Veranstaltungsunterlagen an. Die Unterlagen dürfen nur durch den Teilnehmenden persönlich genutzt und nur mit vorheriger schriftlicher Einwilligung von Plantco.de e.V. und der ReferentInnen bzw. Dritten ganz oder in Auszügen vervielfältigt, veröffentlicht oder an Dritte weitergegeben werden.
Plantco.de e.V. ist berechtigt, gewerbliche Bild- und Videoaufnahmen von, auf und im Zusammenhang mit der Veranstaltung anzufertigen bzw. anfertigen zu lassen und insbesondere zu Marketingzwecken zu nutzen. An Aufnahmen, an denen ein Recht des Teilnehmenden am eigenen Bild entsteht, räumt der Teilnehmende Plantco.de e.V. das unentgeltliche, räumlich und zeitlich unbeschränkte Nutzungsrecht an deren Verwendung ein.
Ist der Teilnehmer Verbraucher im Sinne des § 13 BGB gilt Folgendes:
Widerrufsbelehrung
Widerrufsrecht: Der Teilnehmende kann die Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in jeder Form gem. § 355 I 2 BGB widerrufen. Die Widerrufsfrist beträgt 14 Tage ab dem Tag des Vertragsschlusses.
Zur Wahrung der Frist genügt die rechtzeitige Absendung des Widerrufs.

bfss2018@plantcode-mail.biologie.uni-marburg.de.
Widerrufsfolgen: Im Falle des Widerrufs sind ggf. beiderseits empfangene Leistungen zurück zu gewähren. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für den Teilnehmenden mit der Absendung der Widerrufserklärung, für Plantco.de e.V. mit deren Empfang.
Nebenabreden bedürfen zu ihrer Wirksamkeit der Schriftform. Dies gilt auch für die Änderung der Schriftformklausel. Allgemeine Geschäftsbedingungen des Teilnehmenden haben keine Gültigkeit.
Sollte eine der Bestimmungen dieser Allgemeinen Geschäftsbedingungen unwirksam sein oder werden, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt. Anstelle der unwirksamen Bestimmung tritt eine dem Sinn und Zweck dieser Allgemeinen Geschäftsbedingungen entsprechende, angemessene und zulässige Regelung.
Erfüllungsort und Gerichtsstand ist Freiburg im Breisgau.
The Terms & Conditions govern the contractual relationship between the Black Forest Event 2018 and the organizer, Plantco.de e.V., Geschäftsstelle Leopoldring 5, 79098 Freiburg.
Participants can register online by using the event website, [http://plantco.de/BFW2018/]. The registration constitutes a binding offer for the conclusion of an agreement. The agreement shall only be deemed to be concluded upon acceptance by the registered association, Plantco.de e.V. If the registration for the event can be accepted, the participants will receive a confirmation of registration by email.
The participation fee can be found on the registration page. The fee indicated there includes participation in the event (overnight stay at the Leistungszentrum Herzogenhorn, incl. shuttle service from the Bärental to the event venue and back, a welcome drink, board, including one beverage at mealtimes, along with snacks during the breaks incl. coffee, handouts, excursions and outings). The price does not include the costs of travel to the event venue Bärental / Bergisch-Gladbach or beverages outside mealtimes. All our prices are inclusive of value-added tax (VAT).
Substitute participant
You can designate another participant as a substitute for the registered participant at any time. You will not incur any additional costs as a result as long as there are no problems associated with the assignment of beds (e.g. due to a different gender).
Cancellation
You can cancel the agreement at any time. However, this can only be done in writing.
Please address your cancellation directly to the abovementioned mailing address or send an email to
bfss2018@plantcode-mail.biologie.uni-marburg.de.
If the notice of cancellation is received by Plantco.de e.V. / the stated address of the Sections conference organization team up to 40 days before the beginning of the conference, the reservation will be cancelled. You will be charged a processing fee of EUR 25. In the event of a request for cancellation received after this date and/or non-attendance, the full conference fee will be charged. In this case, the conference papers will be sent to the registered participant upon request.
Plantco.de e.V. can cancel the event and give notice to terminate the agreement for cause at any time for organizational reasons or due to other unforeseen major events (force majeure, too few participants or if multiple speakers are unable to present, among others). In this case, the parties’ mutual obligations to perform do not apply; the participants will be paid back the fee they have already paid. Any other liability and compensation claims, in particular, reimbursement for tickets for airplane, train or other means of transport already booked and hotel reservations already made shall be excluded insofar as intentional or gross negligence is not involved.
Plantco.de e.V. is authorised to make necessary changes in respect of contents, methods and organization or deviations prior to or during the event, insofar as they do not significantly change the benefit of the announced event for the participant. We are authorised to replace the planned presenter if necessary (e.g. in the event of illness, accident) by other persons with similar qualification with regard to the announced topic.
Plantco.de e.V. shall only be liable without limitation for intentional and gross negligence on the part of its legal representatives and vicarious agents. Plantco.de e.V. shall not be liable for any loss of objects brought to the event.
The participants recognise the copyrights of Plantco.de e.V. and/or the presenter/a third party for the event papers. The papers may only be used by the participants themselves and may only be copied, published or passed on to third parties in full or as excerpts with the prior written consent of Plantco.de e.V., and the presenter and/or third party. Plantco.de e.V. is authorised to prepare commercial images and videos of, at and in connection with the event or have same prepared and, in particular, to use same for marketing purposes. The participant shall grant Plantco.de e.V. rights of use for such images and videos at no charge and with no limitation in terms of space and time for images for which rights for own images arise for the participant.
If the participant is a consumer within the meaning of Section § 13 of the German Civil Code (BGB), the following shall apply:
Information regarding cancellation
Right of cancellation: The participant can cancel the contractual declaration within 14 days in any form without giving reasons in accordance with Section 355 of the German Civil Code (BGB). The deadline for cancellation shall be 14 days from the day the agreement is entered into.
Timely dispatch of the cancellation shall suffice for compliance with the deadline.
The cancellation must be addressed to:

Consequences of cancellation: In the event of a cancellation, payments received by either party must be returned if applicable. The parties must comply with their obligation to return payments within 30 days. The term applying for the participant shall begin upon dispatch of the cancellation declaration; the term applying for “name of the registered association” shall begin upon receipt of such declaration.
Ancillary agreements shall only be valid if effected in writing. This shall also apply for any amendment of this written form clause. Any general terms and conditions of the participant shall not apply. In the event that one of the provisions of these General Standard Terms and Conditions is invalid or becomes so, such invalidity shall not affect the validity of the other provisions. The invalid provision shall be replaced by an appropriate and admissible provision corresponding to the spirit and purpose of these General Terms and Conditions. Freiburg im Breisgau shall be the place of performance and jurisdiction.
